1. Agreement to Terms
By accessing or using fold.run (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you agree to these Terms on behalf of that organization. If you do not agree, do not use the Service.
2. Description of Service
fold.run is a deployment platform for AI agent tools. The Service allows you to deploy, manage, and scale code ("Functions" or "Tools") that are accessible via HTTP, the Model Context Protocol (MCP), and the Agent-to-Agent (A2A) protocol. The Service includes a web console, CLI, and API.
3. Accounts
You must create an account to use the Service. You are responsible for maintaining the security of your account credentials, including passwords, API keys, and tokens. You must notify us immediately if you believe your account has been compromised.
You must provide accurate and complete information when creating your account. You may not create accounts for the purpose of violating these Terms or for any unlawful purpose.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Deploy code that is malicious, harmful, or designed to exploit vulnerabilities
- Distribute malware, viruses, or other harmful software
- Engage in unauthorized access to other systems or networks
- Send unsolicited bulk communications (spam)
- Mine cryptocurrency or perform computationally abusive operations
- Store or transmit content that infringes on intellectual property rights
- Interfere with or disrupt the Service or other users' use of the Service
- Circumvent rate limits, usage quotas, or other service restrictions
- Resell or redistribute access to the Service without authorization
We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.
5. Your Content
You retain ownership of all code, data, and content you deploy to the Service ("Your Content"). By deploying content, you grant us a limited license to host, run, and serve Your Content solely for the purpose of providing the Service.
You are solely responsible for Your Content, including ensuring it complies with applicable laws and does not infringe on third-party rights. We do not review, endorse, or assume liability for Your Content.
6. Service Plans and Billing
The Service offers Free, Pro, Scale, and Enterprise plans. The Free plan is provided at no cost with usage limits. Paid plans are billed monthly or annually through our payment processor, Stripe. The Scale plan requires a custom domain and is designed for high-volume production workloads.
On the Free plan, requests exceeding your monthly activation cap are blocked. On Pro and Scale plans, overages are metered and billed automatically at published per-unit rates.
You may upgrade, downgrade, or cancel your plan at any time from the Console. Changes take effect immediately and are prorated. Refunds are not provided for partial billing periods.
We reserve the right to change pricing with 30 days' notice. Price changes do not apply retroactively to the current billing period.
7. Rate Limits and Quotas
Each plan includes specific rate limits and resource quotas. Requests exceeding your rate limit are rejected with HTTP 429 status codes. Your deployed tools remain available and resume serving once the limit resets.
We may adjust rate limits to protect the stability and performance of the Service for all users.
8. Secrets and Security
The Service provides encrypted secret storage for API keys and credentials. Secrets are encrypted at rest using AES-256 and injected into your tools at deploy time. While we take reasonable measures to protect your secrets, you are responsible for managing access to your account and rotating credentials as needed.
9. Availability and Support
We strive to maintain high availability but do not guarantee uninterrupted service. The Service is provided "as is" without warranty of any kind. Planned maintenance windows will be communicated in advance when possible.
Support is provided according to your plan level: community support for Free, priority support for Pro, and dedicated support for Enterprise.
10. Intellectual Property
The Service, including its design, features, and documentation, is owned by fold.run and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets.
11. Limitation of Liability
To the maximum extent permitted by law, fold.run shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.
Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Termination
You may terminate your account at any time by contacting us. We may terminate or suspend your account for violation of these Terms, non-payment, or for any reason with 30 days' notice.
Upon termination, your deployed functions will be taken offline. You may export your code and data before termination. We may retain certain data as required by law or for legitimate business purposes.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
